Cape Town – The uMkhonto weSizwe (MK) Party has criticised the Western Cape High Court’s decision to suspend Parliament’s Section 89 impeachment inquiry into President Cyril Ramaphosa over the Phala Phala matter.
The court on Friday granted Ramaphosa an interdict against the Section 89 committee, effectively halting the impeachment proceedings pending further legal processes.
Reacting to the judgment, MK Party MP David Skosana said the ruling came as no surprise and accused the judiciary of applying the law inconsistently.

“As expected. Anyway, we are not shocked. It depends who you are in this country.”
Skosana said the party remained disappointed by the outcome, arguing that similar legal arguments had previously been rejected in other matters.
“If you remember Section 194, there was a separation of powers. This so-called interdict was not granted. The same judge refused it. He said separation of powers. It depends on who you are. Our law has eyes.”
He added that members of the impeachment committee would provide further comment on the matter.
MK Party member Andile Mngxitama also criticised the ruling, alleging that the judiciary had consistently protected the President.

“We were disappointed, but it’s not unexpected. The judiciary has consistently protected Mr Ramaphosa.”
Mngxitama questioned Ramaphosa’s argument that appearing before the impeachment committee would damage his reputation.
“If he has nothing to hide, why should his reputation be affected? If he is not guilty for stuffing his freezer with dollars, which have not been accounted for, why is he afraid to come before the impeachment committee?”
He described the court application as a delaying tactic and said the party believed the judgment would postpone accountability.
Mngxitama further claimed that the ruling prevented Parliament from scrutinising allegations surrounding the Phala Phala matter, including the origin of foreign currency found at the President’s farm and other alleged irregularities.

He also alleged that previous court decisions had shielded Ramaphosa from public scrutiny, including matters relating to campaign funding.
The MK Party said it is considering approaching the Constitutional Court directly to seek clarity on the matter.
“The MK Party will seriously consider taking the matter up with the Constitutional Court on a direct access basis, so that the court makes a clear determination that it has a final say on these matters.”
