Pretoria – EFF leader Julius Malema celebrated outside the Constitutional Court after it ruled that Parliament acted unlawfully in rejecting the Section 89 panel report into the Phala Phala scandal involving President Cyril Ramaphosa.
The court found the National Assembly’s December 2022 decision irrational and unconstitutional, ordering Parliament to properly reconsider the report and reopening the possibility of a full impeachment inquiry.
The case, brought by the EFF and the African Transformation Movement (ATM), challenged Rule 129 of Parliament’s impeachment procedures, which the court found gave lawmakers excessive power to block impeachment proceedings.

Malema said “Phala Phala will never die” and urged the ANC to choose between Ramaphosa and South Africa.
ATM leader Vuyo Zungula said the ruling confirmed Parliament had failed in its oversight role.
The judgment brings renewed focus to the 2020 burglary at Ramaphosa’s Phala Phala farm in Limpopo, where about $580,000 in foreign currency was allegedly stolen.
