Pretoria – Lawyers representing Crime Intelligence deputy Feroz Khan have warned the Madlanga Commission that an independent medical examination could potentially worsen his condition.
Khan, who remains hospitalised, is expected to undergo scrutiny over his medical condition as the commission considers whether he is fit to participate in proceedings.
Appearing before the commission on Tuesday, Khan’s legal team objected to an independent assessment, citing concerns that the presence of another medical expert could trigger a deterioration in his condition.
His lawyer referred to what he described as a “white coat effect”, saying the involvement of a third-party medical expert could potentially trigger a further “cascade” in Khan’s current condition.
The legal team suggested that any expert appointed by the commission should first consult Khan’s treating doctor to establish whether an independent examination would pose a medical risk.

“If there’s no medical impediment, then we can address you on the legal impediment,” Khan’s lawyer told the commission.
The lawyers also raised the possibility of a legal challenge if Khan were to be compelled to undergo an independent medical examination against his wishes.
They said there would be no legal obstacle if Khan voluntarily agreed to the assessment but questioned whether the commission had the authority to force him to undergo one.
