The application forms part of an ongoing legal battle between the two, which began after Mchunu allegedly made claims linking Malema to criminal activity and other serious allegations during media interviews and social media posts.
Court records indicate that Mchunu has previously been ordered to retract statements and issue apologies after earlier rulings found him in contempt for violating court instructions.
The latest application comes after Malema’s legal team argued that Mchunu has not complied fully with existing court orders and has continued to repeat similar statements in public.
The case is expected to return to court on 17 June 2026.
