Johannesburg – The Electoral Court has dismissed the uMkhonto weSizwe (MK) Party’s application to set aside the results of South Africa’s 2024 national and provincial elections.
The party had argued that the election results were compromised after the Electoral Commission of South Africa’s (IEC) results dashboard went blank for about two hours on 31 May 2024.
However, the court found the MK Party’s case to be “flawed”, saying the audit trail showed that results continued to be captured and edited while the dashboard was offline.
“The audit trail indicates that the results continued to be captured and edited over this period, unaffected,” the court ruled.
It also found no evidence that the IEC’s results system lacked integrity, saying the commission’s account was based on “proven and undisputed facts”, while the MK Party’s case relied on inferences.
The court further ruled that the party had failed to follow the mandatory objections procedure under the Electoral Act, making its application legally incompetent.
The IEC welcomed the judgment, saying its responsibility was “to protect the integrity, credibility, and fairness of the electoral outcomes”.
The commission said it would now finalise an independent external audit of the results system ahead of the 4 November 2026 elections.
