Cape Town – Civil rights organisation AfriForum has welcomed the sentencing of Economic Freedom Fighters (EFF) leader Julius Malema to five years’ direct imprisonment, describing the ruling as a victory for accountability and the rule of law.
AfriForum CEO Kallie Kriel said the court’s decision sends a clear message that no individual is above the law, following Malema’s conviction in connection with a firearm incident at a political rally.
Malema’s case stems from a widely circulated 2018 incident during the EFF’s fifth anniversary rally at Sisa Dukashe Stadium in Mdantsane, where he was seen firing what appeared to be a rifle into the air in front of thousands of supporters.
The incident later led to charges of unlawful possession of a firearm and ammunition, discharging a firearm in a public space, and reckless endangerment.

He was convicted after a lengthy trial, with the court finding that the act was deliberate and pre-planned rather than accidental or impulsive. Malema had pleaded not guilty, arguing that the weapon was a toy.
“Malema and the EFF acted with impunity and it was essential for the court to send a clear message that no one is above the law,” Kriel said in a statement shared on social media.
He added that although the case took eight years to conclude, the outcome demonstrates the importance of persistence in pursuing justice.
Kriel further warned that the ruling should serve as a caution to politicians and others who break the law, saying they would be held accountable.
AfriForum said it would continue to push for a criminal justice system that operates “without fear, favour or prejudice.”
Cape Town Mayor and DA leader Geordin Hill-Lewis also welcomed the sentencing of EFF leader Julius Malema, saying it reinforces the importance of law enforcement and public safety.
“No one is above the law,” he said, adding that gun violence and illegal firearm offences must be taken seriously and that the ruling would help restore faith in South Africa’s justice system.

His remarks were echoed by other political leaders reacting to the court’s decision.
Build One South Africa leader Mmusi Maimane urged against celebrating Malema’s downfall, while Sport, Arts and Culture Minister Gayton McKenzie expressed sympathy for Malema and his family, saying prison impacts families deeply.

South African Federation of Trade Unions (Saftu) General Secretary Zwelinzima Vavi said the ruling left him in “profound shock”, questioning whether legal standards had been applied consistently.

Malema, addressing supporters outside court, welcomed their support and said he intends to appeal both his conviction and sentence.
He also criticised the magistrate’s handling of the case and confirmed he will take the matter to higher courts, including the Constitutional Court if necessary.
