Johannesburg – The uMkhonto weSizwe Party (MK Party) has asked President Cyril Ramaphosa to launch an inquiry into whether former NDPP Shamila Batohi is fit to receive her pension and post-tenure benefits.
The party has applied urgently to the Gauteng High Court to suspend Batohi’s pension pending the inquiry.
The request is based largely on Batohi’s conduct during the NPA-related Nkabinde Inquiry, where she was a witness.
The MK Party argues that her decision to walk out of cross-examination while under oath showed a lack of integrity and ethical conduct expected of a senior public official.

The party wants a judge-led inquiry with limited terms of reference to determine whether her conduct in office and during the inquiry should disqualify her from receiving pension and other benefits.
“The inquiry’s terms of reference should be confined to solely determining whether the NDPP’s conduct in office, including but not limited to the events at the Nkabinde Inquiry, disentitle her from receiving her pension, and gratuities, or any post tenure benefits,” the papers read.
“Such a mechanism, preferably led by a judge with simple terms of reference and rules observing natural justice, is necessary to ensure legality, rationality, and compliance with constitutional principles of transparency, accountability, and prudent financial management.”
The matter is expected to be heard in court in March.
