Johannesburg – The criminal case against self-described political fixer Oupa “Brown” Mogotsi has been postponed to 13 November after the prosecution asked for more time to respond to a defence application seeking additional evidence and information.
Mogotsi appeared in the Johannesburg Regional Court on Friday, where the state said it needed time to prepare its response to the application, which it had received recently.
The defence is seeking further particulars and documents it says are necessary to prepare for trial, including cellphone records of state witnesses, employment records, proof of residence, unredacted witness statements and images extracted from video footage of the alleged shooting.
According to TimesLIVE, the prosecution had responded to an earlier request for further particulars but had not yet prepared its response to the substantive application and supporting affidavit.
The defence did not oppose the postponement but criticised the late delivery of the application, saying the state needed adequate time to respond. The prosecution apologised for the oversight and agreed to the delay.
The case against Brown Mogotsi has been postponed until 13 November, and he remains in custody.
Mogotsi appeared today at the Johannesburg Magistrate’s Court facing charges of unlawful possession of a firearm, perjury, and defeating the ends of justice.

The court expressed concern about repeated postponements and stressed that both parties needed to exchange documents on time to prevent further delays.
The state has been directed to provide its response at least two days before the next hearing, giving the defence time to prepare.
Mogotsi’s legal team wants access to information relating to state witnesses, including records for witnesses identified as A5 and A6. The defence argues that the material could help it assess the credibility of witnesses, identify possible inconsistencies and prepare for cross-examination.
The dispute over disclosure has delayed progress towards trial. In an earlier hearing, the defence said it was dissatisfied with the state’s response to its request for further particulars.
“We have received what is purported to be a response. I can advise the court to submit that we are dissatisfied with the response from the state,” defence counsel told the court, according to the Mail & Guardian.
The defence maintains that the requested information is needed to investigate the allegations and prepare Mogotsi’s case. The state has raised concerns about disclosing certain details relating to witnesses.

Mogotsi faces charges including perjury, defeating the ends of justice, unlawful possession of a firearm and ammunition, and discharging a firearm in a public place.
The charges relate to allegations that he staged an assassination attempt against himself in Vosloorus in November 2025.
The state alleges that Mogotsi fired shots at his vehicle and then reported that unknown gunmen had attacked him. He has not been convicted of the charges and remains legally presumed innocent.
The criminal case has attracted wider attention because Mogotsi has also featured in allegations raised before the Madlanga Commission of Inquiry concerning alleged interference in police affairs and sensitive investigations. Those allegations are separate from the criminal charges before the court.
The matter is scheduled to return to the Johannesburg Regional Court on 13 November for further consideration of the defence application and the state’s response.
