Pinetown – National Coloured Congress (NCC) leader and MP Fadiel Adams’s fraud case has been transferred from Pinetown to Durban, with the prosecution citing security concerns and a congested court roll.
Adams appeared at the Pinetown Regional Court on Friday, 16 October, for a pre-trial conference. According to The Citizen, State prosecutor Nokulunga Ngcobo told the court that the prosecution and defence had agreed to move the matter to the Durban Magistrate’s Court.
“We’ve received security concerns from the members of the SAPS, as well as the fact that we were advised the court roll in this court is a bit congested,” Ngcobo said.
She said the transfer would allow the matter to be accommodated more quickly.

Adams’s lawyer, Devin Moodley, said his client did not oppose the move because of the pressure on the Pinetown court roll. However, he questioned the reference to security concerns, saying it was the first time he had heard of them.
The case has been postponed to 11 December for a pre-trial conference at the new venue.
Speaking outside court, Adams accused the KwaZulu-Natal Political Killings Task Team (PKTT) of using the security concerns to delay the proceedings. These allegations have not been established in court.
“They cite security concerns in court. Why didn’t they notify us if there were security concerns?” Adams asked, according to Eyewitness News
“That doesn’t make any sense. Was I supposed to be shot on the way to court if there’s a security concern?”
The NCC leader alleged that the authorities were trying to prevent evidence in the case from being examined.
“This is why they are moving my case to yet another court, because they don’t want the crap in their documents on the table,” he told reporters.

Adams also described the development as an embarrassment for the National Prosecuting Authority (NPA), saying he had arrived prepared for the pre-trial proceedings.
He further warned that he intended to pursue civil claims against senior police officers in their personal capacities.
Adams faces three counts of fraud and two counts of defeating the ends of justice. The charges relate to allegations that he misrepresented himself to officials to gain access to Westville Correctional Centre, where he interviewed two inmates without the required authorisation.
The State alleges that the visits took place in November 2024 and January 2025 and that Adams conducted recorded interviews with the inmates.

One of the men was Sibusiso Ncengwa, who was convicted in connection with the 2017 murder of former ANC Youth League secretary-general Sindiso Magaqa. Ncengwa is serving a 25-year prison sentence.
Adams was arrested in Cape Town in May and later released on R10,000 bail.
He has previously dismissed the State’s case as a “joke” and maintained that his actions would be vindicated when the matter reaches trial.
The charges remain allegations, and Adams has not been convicted in the case.
The matter is due back in court on 11 December for a pre-trial conference.
