Cape Town – The National Assembly has adopted amended rules to guide the work of the 31-member impeachment committee investigating President Cyril Ramaphosa over the Phala Phala farm scandal, allowing the committee to proceed despite the president’s legal challenge to halt the process.
The amendments follow a Constitutional Court ruling that found Parliament’s previous impeachment rules invalid and paved the way for the committee to continue its work.
Committee chair Makashule Gana said the inquiry was moving ahead, with members expected to finalise terms of reference and appoint evidence leaders.

Opposition parties raised concerns about Parliament’s handling of the process, with the EFF criticising Speaker Thoko Didiza’s decision not to oppose Ramaphosa’s court application, while ActionSA and BOSA accused Parliament of allowing political interests to interfere with constitutional accountability.
The DA’s proposal that impeachment committee members should meet a “fit and proper” standard was rejected, with some parties arguing the requirement was unclear, while the DA maintained that impeachment proceedings required members with high ethical standards.

The impeachment committee was established after the Constitutional Court referred the Section 89 Independent Panel report back to Parliament. The report found prima facie evidence of possible serious misconduct and constitutional violations linked to the Phala Phala matter.
Ramaphosa is challenging the report in court and wants the impeachment process suspended until his review application is concluded. The committee, however, has maintained that its work will continue.
