Johannesburg – The Johannesburg High Court has struck Julius Malema‘s R1 million defamation lawsuit against Kenny Kunene off the court roll due to a procedural issue.
Malema is suing Kunene over statements made during an appearance on the Podcast and Chill platform, where Kunene allegedly linked the EFF leader to late taxi boss Jothan Msibi and criminal cartels. Kunene also claimed Malema made visits to Msibi’s farm and had previously lived in tobacco businessman Adriano Mazzotti’s backroom.
In his court papers, Malema argues that Kunene’s remarks were defamatory and intended to associate him with criminal activity.
According to EWN, The case was removed from the roll after Malema’s legal team failed to upload their heads of argument to the court’s Caselines system within the required timeframe.
Despite the setback, Malema’s attorneys intend to correct the procedural defect and re-enrol the matter for hearing at a later date.
