Johannesburg – EFF leader Julius Malema has accused the Constitutional Court of unjustifiable delays in delivering its judgment on President Cyril Ramaphosa’s Phala Phala scandal.
During a march to the ConCourt in Johannesburg on Friday, Malema and EFF supporters demanded the immediate release of the ruling, saying the case was heard in November 2024 yet no verdict has been issued.
Malema argued that the court was failing its constitutional duty by not meeting its own timelines, questioning its credibility and suggesting some judges may be compromised.
“For more than a year, the Constitutional Court, the highest court in the land, cannot produce a simple judgment,” Malema said.

He questioned the court’s integrity, pointing out the contradiction of expecting lower courts to meet deadlines while missing its own.
“How do you say those who fall under you must release a judgment after three months when the matter is concluded, but you can take the whole year?
“If you say the law courts must take three months, you must take two months to show them that you are leading by example and they must follow your example. Justice delayed is justice denied,” said Malema.
He labelled Ramaphosa “a criminal” and criticised the NPA for not pursuing charges, calling for outgoing NDPP Shamila Batohi to be arrested.
He insisted the section 89 panel found Ramaphosa had a case to answer and urged Parliament to revive impeachment processes, saying a no-confidence motion would be insufficient.
Malema concluded his speech with the chant Dubul’ ibhunu.

Chief Justice Mandisa Maya has dismissed claims that the delay is suspicious, stating there is nothing sinister about the time taken to finalise the judgment.
