Johannesburg – Deputy National Police Commissioner Shadrack Sibiya has failed in his bid to return to work after being placed on leave by National Police Commissioner Fannie Masemola amid an ongoing investigation.
Sibiya sought a court review to overturn the leave and block further disciplinary action, but the Gauteng High Court on Tuesday dismissed his application, stating he had not raised any constitutional challenge and had made “overbroad and unfounded allegations” against Masemola.
“Taking all the above factors into consideration, in the exercise of our discretion, we find no cogent reasons to depart from the general rule.

“ln the premises the following order is made: The application is dismissed with costs,” the judgment read.
Sibiya’s leave followed corruption allegations by KZN Police Commissioner Nhlanhla Mkhwanazi, who accused him of criminal conduct and involvement in disbanding SAPS’s political killings task team.
Sibiya has denied the accusations.
Masemola indicated Sibiya could return if not suspended, with a final decision on disciplinary action pending the investigation’s outcome.
