Cape Town – The Bloemfontein High Court has ruled that the extradition of Moroadi Cholota, former personal assistant to ex-Free State Premier Ace Magashule, from the US was unlawful.
The decision came during a trial-within-a-trial in the R255-million asbestos roofing removal case.
The state had argued Cholota failed to prove her claims of torture and relied solely on state witness evidence. It also dismissed the relevance of alleged misrepresentations about her links to Kenya.
Both the state and defence had contested the court’s jurisdiction over Cholota in their closing arguments.
